How to apply for disability

People with disabilities are entitled to a pension from the state, some benefits, assistance in rehabilitation, as well as the opportunity to avoid being called up for military service or as part of mobilization. Let’s figure out how to get it right.

Who can apply for a disability

This can be done by a personwhich theDecree of the Government of the Russian Federation of April 05, 2022 N 588 “On the recognition of a person as a disabled person”:

  • Has a health disorder with a persistent disorder of body functions. It can be caused by illness, injury or defect.
  • Limited in life – cannot fully serve themselves, move, communicate, navigate, and so on.
  • Needs rehabilitation and habilitation. Habilitation is a different kind of measures that should help a person, if possible, return to a full life.

Compliance with only one of the criteria is not the basis for issuing a certificate. The decision of the competent authorities is taken comprehensively. At the same time, they can assign the first, second or third disability group, depending on the state of health. The first means that the disease significantly limits life: a person is usually completely dependent in his life on assistants. People with the third group are often quite autonomous in everyday life and can work. Children under 18 receive the status of “disabled child”.

People with disabilities do not necessarily have a chronic, incurable disease. If it is long, this is enough for paperwork. For example, with a complex fracture , which has not healed in time, requires repeated medical intervention and does not allow a person to live as before, you can get this status. At the same time, if the disease is chronic and incurable, but does not create any special difficulties, disability will not be given. For example, the removal of a kidney without serious consequences is not considered the basis for issuing a certificate.

What documents do you need to apply for a disability?

This list is not exhaustive and you may be asked for additional documents. But mostly you need:

  • passport;
  • referral for medical and social expertise;
  • consent to ITUOrder of the Ministry of Health of the Russian Federation dated February 02, 2021 No. 39n “On approval of the form of consent of a citizen for referral for a medical and social examination”;
  • medical documents confirming the state of health (card from the clinic, extracts from hospitals, and so on).

The medical institution that issues the referral sends the papers to the bureau itself. They can also be taken personally or sent by registered mail if, for example, the clinic was refused. In general, it is better to check on the spot. Perhaps your documents are ready to be accepted online or in some other way.

How to apply for disability

Get a referral for a medical and social examination

The decision whether to give a person the status of a disabled person and which group is made based on the results of a medical and social examination (ITU). But you need to get direction there. HisissuesDecree of the Government of the Russian Federation of April 05, 2022 N 588 “On the recognition of a person as a disabled person”clinic or other medical organization where the patient is being treated. You can contact your doctor, deputy chief physician for clinical and expert work, directly to the chief physician.

If you are not given a referral, ask for a written waiver. You can already apply with it directly to the Bureau of Medical and Social Expertise (including online through the State Services). They have the right to appoint an examination for you and, based on its results, decide whether you need a medical and social examination.

Pass a medical and social examination

The examination is usually carried out in the bureau at the place of residence or stay. Specialists will study the documents and, if necessary, may prescribe additional examinations.

What will be given according to the results of the medical and social examination

If a person is assigned a disability, he receives:

  • a certificate confirming this fact, indicating the group of disability;
  • individual rehabilitation and habilitation program (IPRA).

If not, then you can get a certificate of the results of the medical and social examination.

How long does it take to apply for a disability?

The medical institution sends the referral to the ITU bureau within three days. The verdict must be issued within 30 days from the date of registration with the referral office from the medical organization. If a person needs palliative care or is in the hospital due to limb amputation, the time is reduced to three days. This is ideal. If it turns out that something is wrong in the direction or additional research is needed, the period may increase.

What to do if you do not agree with the result of the examination

You can apply within a month to the same bureau where the examination took place, or to the main bureau. ITU will have to be held again by specialists at a higher level. If this does not lead to the desired result, you can go to court.
