Legal guide on Identity card blocking

It gives an account of the procedure that must be followed to block the national identity card, passport and other documents.

In which cases can identity documents be blocked?
In case of loss, theft or theft of an identity card (card), a passport, a travel document or a driver’s license.

Travel titles are special documents that are granted to foreigners to leave Chilean territory. They are given to citizens of countries that do not have consular representation in Chile or that have any other impediment to obtain a passport in their country of origin.

Before which organism is the blockade made?
It is carried out before the Civil Registry and Identification Service. The person who suffers the theft, theft or loss of the document must block immediately once she realizes that she does not have the document in her possession.

Is the person doing the blocking legally responsible if the document is misused?
It will be presumed for all legal purposes that the owner of the documents has not misused them from the moment they are blocked. When it comes to a temporary blockage, the person must transform it into a permanent blockade so that he is not blamed for the misuse when the set period expires. But he could be convicted if it is possible to prove in court that indeed the owner of the documents was the one who misused it.

The Civil Registry and Identification Service gives the person a proof of the blockade, with which they can prove the date and time that the procedure was carried out.

Is the blockage always permanent?
The blocking of an identity card can be requested permanently or temporarily. Regarding the passport, only the definitive blocking will proceed.

How is the definitive blocking of documents done?
The definitive blocking request must be made by the owner of the document, that is, the person to whom the documents belong, before any office of the Civil Registry and Identification Service and must contain:

  • Full name and Unique National Role (RUN)
  • Reason for blocking, which cannot be other than loss, theft or robbery.
  • Signature of the applicant.

If a person makes the definitive blocking of their identity card or passport, the Civil Registry and Identification Service must process the delivery of a new document.

What happens if the loss, theft or robbery occurs abroad?
In that case, the application for a definitive blockade may be made before the respective consular office, with the same formalities in Chile.

Can the definitive block be done electronically?
Yes, but only if the legally authorized advanced electronic signature is used.

How is the temporary blocking of the identity card done?
The request for temporary blocking is the one made by telephone or electronically, through the website of the Civil Registry and Identification Service. This block will be in effect for two business days after the day the block is made. You can request the renewal of this block only once, within the last day of the expiration of the term. After this period, the person can make a new temporary block.

The temporary blocking serves so that a person is not blamed for the misuse of the document if they do the definitive blocking within the two days of validity.

What happens if a person falsely declares that they lost, stolen or stolen their identity card or passport?
Whoever obtains the blockade through a false declaration of the reasons will be punished with a fine of 6 to 10 monthly tax units.

The law also penalizes the fraudulent use of the blocked document.
